Terms and Conditions of Brand Visibility Support plans
1. AGREEMENT OVERVIEW
By signing up for a Brand Visibility Support, you (“Member”) agree to the following Terms and Conditions, which outline the services provided, payment terms, and the rights and obligations of both the Member and Photography by Fran (“Company”).
2. MEMBERSHIP SERVICES
The Company offers the following services as part of the Brand Visibility Support plans:
- Brand photography sessions
- Marketing strategy call
- Social media marketing content creation
- Email marketing services
- Monthly marketing support
The specific services offered depend on the membership level chosen by the Member. Please refer to the package descriptions for full details of services provided at each level.
3. MINIMUM TERM
The minimum Brand Visibility Support term is 3 months. The Member is required to commit to and pay for the chosen membership package for at least this period. After the initial 3-month term, the membership will continue on a month-to-month basis unless cancelled as per the cancellation terms outlined below.
4. PAYMENT TERMS
- Fees are charged monthly in advance, beginning 48 hours after our initial zoom and continuing on that date of each month following.
- Failure to pay the fee on time may result in suspension of services until payment is made.
5. PHOTO SESSIONS
- Members are entitled to one 40-minute brand photography session every 3 months. Sessions must be scheduled in advance and are subject to availability.
- Photo session locations must be within a 45mile distance of Swindon. Locations within 25 miles of Swindon are provided at no extra travel cost – locations outside this distance may incur additional costs. Every extra mile will be charged at 45p/mile + £10 per hour (if over 30 minutes).
- Photo sessions are based on the shoot taking place within my usual working hours (Monday-Friday 9am-5pm). Shoots outside of this time may incur an additional charge.
- The first photography session will take place (at a day and time discussed and agreed between the Member and the Company) a minimum of 6 weeks after first monthly payment.
- Photo sessions not used within the 3-month period do not roll over into the next period. However reasonable exceptions may apply.
- Any requests for rescheduling must be made at least 48 hours in advance.
6. MARKETING SUPPORT
- Members will receive marketing support each month. The method of Marketing support may vary, either written content, recorded video or group zoom sessions.
- Group Zoom sessions will be recorded for those who cannot attend live.
- One free 30 minute 1-1 strategy call, will be offered on a 3 monthly basis to discuss imagery needed to work with your marketing strategy.
7. CONTENT CREATION
For plans that include social media content creation:
- Posts will created based on the number of posts and platforms selected at the time of sign-up.
- Members must provide any necessary information, branding guidelines, and content (e.g., images, logos) required for the creation of posts.
- Posts will consist of imagery/graphics along with written content, based on discussions between the Member and the Company. This will be supplied to the Member weekly, and 1 edit is included in each post, additional edits may be charged.
8. BLOG POSTS & EMAIL MARKETING
For plans that include blog posts and email marketing:
- The Company will write 1 blog post and 1 email per calendar month, based on discussions between the Member and the Company. This will be supplied to the Member monthly, and 1 edit is included in each month, per each content, additional edits may be charged.
9. CANCELLATION AND TERMINATION
- The Member may cancel their Brand Visibility Support plan after the initial 3-month term by providing 10 days’ written notice via email to fran@photographybyfran.co.uk
- The Company reserves the right to terminate the Brand Visibility Support plan at any time, should the Member violate any of these terms or engage in behaviour that is damaging to the Company’s business or reputation.
10. REFUNDS
- Fees are non-refundable once paid, except in cases where services cannot be delivered due to a fault of the Company.
11. SERVICE CHANGES
The Company reserves the right to modify the services offered in each Brand Visibility Support plan. Any changes to services or pricing will be communicated to Members at least 30 days in advance.
If there is a price increase for the Brand Visibility Support plan for future members, with no changes to the services provided, your current payments will remain unaffected for a minimum of 6 months.
12. LIABILITY
The Company will not be liable for any loss or damage caused by events beyond its reasonable control, including but not limited to natural disasters, equipment failure, or external service provider disruptions.
By enrolling in a Brand Visibility Support plan, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
